General
Our products are made of high-quality materials. This means that they not only fit perfectly and comfortably, but are also really durable. Despite quality controls and tests, we unfortunately cannot promise that your IAMDEDICATED clothes will never get a hole. If one of our products has such a defect, we will provide the following manufacturer's guarantee under certain conditions in addition to the statutory guarantee to which the consumer is entitled against the seller.
The company Connection Neue Medien GmbH, Hauptstraße 37b, 2371 Hinterbrühl, Austria, grants the consumer a time-limited guarantee for the products it manufactures under the following conditions and to the extent described below. The manufacturer's guarantee granted applies without prejudice to mandatory statutory liability provisions, such as the Product Liability Act, in cases of intent and gross negligence, due to injury to life, body or health by the company Connection Neue Medien GmbH or its vicarious agents.
A consumer within the meaning of this manufacturer's guarantee is any natural person who is the owner of the product and has not purchased it in order to resell it privately or to sell it to third parties as part of their commercial or independent professional activities.
Scope of the guarantee
The guarantee conditions apply exclusively within the Federal Republic of Germany and the European Union. The guarantee applies to all products purchased from January 1, 2024 (proof of purchase). The company Connection Neue Medien GmbH guarantees that your products are free of holes. Product liability claims only exist in accordance with the statutory provisions. Within the scope of this guarantee, defects that can be proven to be due to a material defect will be remedied.
All products have a guarantee period of 6 months from the date of purchase of a product. If the product is already defective when delivered in an unworn condition, this must be reported to our support team at hello@iamdedicated.fashion immediately after receipt of the goods. This will then arrange for a replacement delivery to be sent.
Defects that only arise after the product has been worn can be reported using our complaint form. Products that are older than six months are generally excluded from the guarantee. We provide this guarantee by repairing defects that are due to a material defect within the guarantee period free of charge. These defects are repaired by replacing the product, possibly with a successor model or a color that differs from that in the original order. If the same product (e.g. T-shirt) is complained about by the same customer who has purchased this product from several sales channels (e.g. online shop and Amazon), IAMDEDICATED will treat this as one complaint and only take into account the total number of defective individual products.
Each product can only be complained about once per order and size. For example, if a customer orders white T-shirts in sizes XS and S and complains about both products from the same order within six months, they are protected by the guarantee. If a customer complains about white T-shirts in sizes XS and S and mixed black T-shirts in identical sizes, but from a different order, both products are protected by the guarantee. However, if a customer complains about white T-shirts in sizes XS and S and black T-shirts in the same size and from the same order, the product will only be replaced once.
Duplicate entries in our complaint form relating to the identical product of an order number cannot be processed, nor can any meaningful image be attached.
Connection Neue Medien GmbH reserves the right to make a refund or partial refund of the purchase price as an alternative. The services described here apply in addition to the statutory warranties and do not replace or limit them. This guarantee is a voluntary and non-legally binding service provided by Connection Neue Medien GmbH, which can be refused at any time without giving reasons.
Circumstances excluded from the guarantee
Goodwill: In the case of gifts and goodwill services to the customer, the customer is not entitled to a guarantee. A guarantee requires a purchase. The customer must have provided something in return.
Purchase from third-party providers: When purchasing IAMDEDICATED products from third-party providers, there is no entitlement to the guarantee. Gifted products: If you receive products as a gift as part of one of our promotions (e.g. trial promotions), you are not entitled to a guarantee for these products.
Products that were purchased more than 6 months ago are generally excluded from the guarantee.
Replacement of a replacement product
A guarantee claim for a replacement already received only exists if the "replacement for replacement" claim was made within six months of the date of purchase. The renewed claim can only be made if the customer has fewer individual pieces of the already replaced product as a result of the defect than he or she received with the original order (before the first complaint). In other words: We will only replace products for you again if you have fewer intact individual pieces as a result of the defect than you originally ordered.
Asserting the guarantee claim
To assert the guarantee, customers must fill out this form https://iamdedicated.fashion/pages/warranty-form. Customers will be informed about the further process of the complaint processing after receipt of the form. In the event of a guarantee claim, the return is free of charge for you within Germany.
Claims for gifts
In the case of gifts (customer 1 buys from us, gives it to customer 2, customer 2 complains), the guarantee can only be claimed if customer 2 has all of the relevant purchase data from customer 1 (email, order number, name, shipping address). This information may not be changed, but should be used in the same way for the complaint.
Documentation requirement
A guarantee claim only exists if the customer encloses clear photos with the application. In this context, clarity means the clear recognition of the IAMDEDICATED logo, the size and color of the item of clothing and the defect underlying the application.
Note on the guarantee promise § 477 BGB
Completely independent of this manufacturer's guarantee and whether or not the prescribed guarantee is claimed in the event of a guarantee claim, the consumer's statutory warranty claims against the respective seller remain unconditional. Therefore, at your own discretion, the legally regulated buyer rights due to defects in the purchased item, in particular subsequent performance, withdrawal, reduction of the purchase price or compensation (see Section 437 of the German Civil Code) and the corresponding separate limitation rules in Section 438 of the German Civil Code can be asserted against the seller without asserting the warranty claims. The guarantee applies without prejudice to mandatory statutory liability provisions.
Liability
The guarantee declaration does not grant any right to compensation for consequential damage of any kind or other claims for damages. Excluded from this restriction are mandatory statutory provisions according to which the manufacturer is liable outside of this voluntary guarantee declaration.
Exclusion period Limitation period
Claims under the guarantee must be asserted immediately, but no later than 2 months after knowledge of a defect. After expiry of this period, the assertion of rights under the guarantee is excluded. Claims under the guarantee expire after 6 months from the end of the guarantee period.
